Advising Tender Committees

Our legal teams specialize in advising tender committees of entities publishing tenders, and often serve as outside counsel to Israel’s largest public entities in this regard. Over the years, our firm advised on some of the largest and most significant government tenders in Israel.
As outside counsel, we advise tender committees on a wide variety of matters related to the tender. Among others, our legal teams advise on the outline of the contract or tender, including whether there is an obligation to publish a tender and holding other competitive proceedings; advise on formulating the most appropriate tender strategy; draft documents and manage preliminary proceedings, requests for information (RFI) and pre-qualification (PQ); provide advice and guidance on formulating and drafting the terms of the tender, including the threshold, contract and commercial conditions; examine bidders’ proposals, including requests for additional information; providing legal opinions regarding various matters related to the tender; providing legal counsel and representation throughout tender appeal proceedings, as required; and providing ongoing counsel regarding the final contractual agreement and related legal matters, as well as representation in contentious proceedings as required.
