Risk, Ownership and Possession in International Trade – Things a Legal Advisor Must Know

In any international trade of goods, a situation arises in which the goods have left the seller’s possession and are in the possession of a carrier and have not yet been delivered to the buyer. In these cases, the question arises as to who bears the risk in relation to the goods (i.e., in case of loss or damage to the goods during the transport), and when the ownership of the goods is transferred.
